Seller and Artist Policies

Collective49 is a unique marketplace that brings together buyers and creators featuring artwork and products rooted in culture with the mission to promote and enhance Indigenous artists.

Fees and Payments Policy

Sellers will be required to pay the following Collective49 fee. See the Taxes section below for further information. 

Collective49 Transaction Fee

When you make a sale through Collective49, you will be charged a flat 5.4% + $0.30 Transaction Fee that includes both a commission/listing fee and payment processing charge. 

See the Taxes section below for more information about whether you are required to include applicable taxes in your product listing prices and/or product listing options. The Transaction Fee is deducted from the sale amount as each sale occurs, and are reflected in your payment account.

Payment Processing 

Collective49 uses Shopify Payments and/or PayPal, Apple, and Google Payments to accept product payments through www.collective49.com. The Collective49 flat transaction fee covers the cost of the payment processing fees.

Please note that customer credit card and bank processing times may take up to 5 days to be received. Credit card payments received on Fridays and weekends have bank processing times that begin on the following business day, Monday. Customer transactions paid via PayPal, Apple or Google Payments are processed within 24 hours. As soon as customer order payments have been fully processed and posted, Collective49 will transfer funds to the seller via PayPal, Zelle bank transfer or Venmo.

Payment Processing Terms

Collective49 uses Shopify Payments, PayPal Payments, Apple Pay, and Google Pay to process customer payments for sales and purchases. 

An example of Collective49 Transaction Fee

You sell an item with the listing cost of $100 (including shipping) with no sales tax charged.

Transaction Fee: 5.4% + .$30 of $100 (including shipping) = $5.70

TOTAL PAYMENT = $94.30 ($100 minus $5.70)

Taxes

You are responsible for collecting and paying any taxes associated with using and making sales through www.collective49.com and our services. You have sole and exclusive responsibility to determine what, if any, taxes apply to the sale of your goods and services and/or the payments you receive in connection with your use of the Collective49 Payments Services ("Taxes"). It is solely your responsibility to assess, collect, report, or remit the correct Taxes to the proper tax authority, whether in customers’ jurisdictions, your jurisdiction or elsewhere. We are not obligated to, nor will we, determine whether Taxes apply, or calculate, collect, report, or remit any Taxes to any tax authority, arising from any Transaction. Collective49 retains the right, but not the obligation, at its sole discretion, to complete and file tax or related reports with tax authorities regarding Transactions in those jurisdictions where Collective49 deems such reporting necessary. You hereby indemnify and hold Collective49 harmless from and against any and all liability related to Taxes and filings made by Collective49 in respect thereof. You agree that we may send you any tax-related information electronically. 

Registration

The Collective49 payments services are only made available to persons that operate a business selling goods and services. You may not use the Payments Services for non-commercial, personal, family, or household purposes. To use Collective49 Payments including Shopify Payments and PayPal for your business, you are required to register for a Collective49 account. When you register for a Collective49 Account, we will collect information such as your name (if you are a sole proprietor), your business or trade name, your address, email, phone number,  and certain other information that we require.

Accepting These Terms. The Collective49 Payments Policy (or the “Policy”) sets out your rights and responsibilities when you use Shopify Payments and/or PayPal, Apple, Google Payments on Collective49’s services (we’ll refer to collective49.com and other services as our “Services”), so please read it carefully. By using Collective49 service you’re agreeing to the Policy.

Overview. Collective49 Payments allows sellers to (a) accept payment by authorized credit and debit card transactions, some bank transfers services via Shopify Payments, PayPal (where available), transactions using Apple Pay, and transactions using Google Pay, and (b) have those funds deposited into a seller’s designated PayPal, bank or Venmo account.

Collective49 Payment Services is only available to sellers who are at least 18 years old who register and are approved. 

Sellers may only use Collective49 Payment Services for the sale of items listed on Collective49’s marketplace website and agree to ship sold items once a payment transaction is complete and reflected in their Collective49 account. Collective49 reserves the right to terminate a seller’s access to Collective49 if the seller uses Collective49 Payment Services in any other manner. 

Collective49’s Rights and Responsibilities. Collective49 Payments functionality may be made available, modified, or discontinued by us at any time without notice and is subject to the limitations in Collective49’s Terms of Use.

As a security measure, we may impose transaction limits on buyers and sellers. For example, we may impose limits relating to the value of any transaction, deposit, or adjustment, or limits relating to the cumulative value of all transactions, deposits, or adjustments during a period of time. We may also impose limits related to the number of transactions per day or other period of time. We will not be liable to a seller: (a) if we do not proceed with a transaction, deposit, or adjustment that would exceed any limit established by us, or (b) if we permit a buyer to withdraw from a transaction.

Collective49 may refuse service of our services to anyone, for any reason, at any time. Collective49 reserves the right to decline transactions that we believe to be high risk, fraudulent, or in violation of Collective49’s Terms of Use.

In the event that a buyer does not make payment for the purchase of a legitimate item sold using Payments (e.g., where the buyer used a stolen or unauthorized credit card), Collective49 may provide limited payment protection to the seller, in the interest of fairness. 

Collective49 maintains records associated with transactions and does not pass any secure data, including credit card numbers or bank account information, to any sellers. Sellers will only receive shipping information and buyer account information necessary to complete the order. Collective49’s Privacy Policy further explains how we handle user information.

We will send you any relevant notices regarding your use of Collective49 Payment Services.

Use of Collective49 Payments.  As a registered seller you are required as part of our services to use Collective49 Payment Services. Using Payments Services will result in your shop accepting Shopify Payment through authorized credit and debit card transactions, PayPal, Apple Pay, and Google Pay.

Seller Accounts. A seller account allows sellers to track payment amounts, refunds, and fees related to transactions and seller services. Sellers must provide accurate personal information as requested during registration, and are responsible for maintaining and updating that information as necessary. Sellers will not impersonate any person or use any name they are not legally authorized to use. Accounts are only available to individuals who are eligible to be sellers on Collective49 and who have a valid PayPal, bank or Venmo account on file with us.

Disputes. Sellers agree to resolve any disputes directly with a buyer or with the assistance of the dispute management and refund tools available on Collective49, and in accordance with our Terms of Use. In the event that a dispute is escalated to our marketplace staff, Collective49 reserves the right to issue a refund to a buyer if a transaction is found to be in violation of Collective49’s policies.

In the event that a buyer submits a chargeback, Collective49 will respond to the credit card networks on behalf of the seller involved in the transaction; the seller agrees to provide any requested information to us within seven calendar days of the request. 

Communications. We will inform sellers of each transaction, or of other information pertaining to Payment Services, using our standard communication procedures by email. 

Refunds. Refunds or adjustments paid by Collective49 to buyers for payments made through our Payment Services may be initiated using the refund functionality in the seller's payment account for a period of 180 days after the purchase was made. Refunds issued will be in the original form of payment, and if such payment is not available, a credit will be issued.

Taxes. You are responsible for collecting and paying any taxes associated with using and making sales through www.collective49.com and our services.
